Dems won prez and senate votes; rigged system screwed us. Let's use same system to win Supreme Court

Surprising no one, we find that Russia effectively staged a coup and that Senate Majority Leader Mitch McConnell was in on the gambit, and we know that The New York Times covered for them all. If there was ever a need for the Electoral College to spring into action, it’s this year, especially given Hillary Clinton’s dominant popular vote victory.

But barring that, there is something Democrats now NEED to do: Confirm Merrick Garland to the Supreme Court before swearing in the new Senate. We’ve explained before how this would happen, and yes, this would be absolutely legal:

1. Vice-president Joe Biden calls Senate into session.

2. Before swearing in the new senators, the chamber would have 34 Democrats, 2 independents caucusing with Democrats, and 30 Republicans.

3. Democrats move to confirm Garland and all the other judge appointments languishing in the Senate.

4. After voting to confirm those judges, Biden can swear in the new senators as all hell breaks loose.

So what’s there to lose? Comity? Long gone. Respect for democratic norms? The rules make a mockery of our democracy, so why let just the GOP take advantage of that rigged system? It’s time for Democrats to fight fire with fire. The Sunday morning talk shows? Who gives a shit if they get the vapors. And hey, Republicans argued the American people should decide the fate of the seat, and they did—delivering popular vote victories in both the White House and Senate races.

This would be a nuclear option, no doubt, but with Donald Trump’s losing ascension to the White House, we’ve already suffered a thermonuclear blast.

Clinton won the popular vote in the face of Russian meddling, enabled and encouraged by the GOP, and the system still fucked us. Democrats won the Senate popular vote, and the system still fucked us. Time to use the system to fuck them.
