Commentary of the madness on the Supreme Court

At yesterday’s oral argument before the Supreme Court over affirmative action in university admissions, Justice Antonin Scalia said minority students with inferior academic credentials may be better off at “a less advanced school, a slower-track school where they do well,” adding “I don’t think it stands to reason that it’s a good thing for the University of Texas to admit as many blacks as possible.”

The Court is on the verge of declaring unconstitutional all types of race-based affirmative action – preferring instead that if universities grant any special preference in admission they do it on the basis of economic class rather than race. But the Court seems to ignore the fact that universities are already granting preferential admission on the basis of class – to the children of wealthy alumni and wealthy potential donors. One important step would be to make such upper-class affirmative action illegal..
